End User License Agreement

This End User License Agreement (“EULA”) governs the use of fonts licensed by Gradient Type (“Licensor”) to you (“Licensee”). By downloading, installing, or using the fonts, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use the fonts.

1. License Grant

1.1 Desktop License: The Licensor grants the Licensee a non-exclusive, non-transferable license to use the fonts on a specified number of desktop computers, as indicated in the invoice or purchase confirmation.

1.2 Webfont License: The Licensor grants the Licensee a non-exclusive, non-transferable license to use the fonts for displaying text on websites using the @font-face rule, subject to the maximum number of monthly pageviews specified in the invoice or purchase confirmation.

1.3 Application License: The Licensor grants the Licensee a non-exclusive, non-transferable license to embed the fonts within software applications, mobile apps, or electronic documents, subject to the permitted number of installations or distribution copies specified in the invoice or purchase confirmation.

2. Permitted Use

2.1 Desktop License: The Font Software may be used for creating static images, artwork, documents, and printed materials, subject to the limitations specified in this EULA.

2.2 Webfont License: The Font Software may be used solely for displaying text on websites owned or controlled by the Licensee. The Font Software may not be used in a manner that allows for unauthorized dynamic generation of web pages.

2.3 Application License: The Font Software may be embedded within software applications, such as mobile apps, games, and e-books, for display and printing purposes.

3. License Restrictions

3.1 The Licensee may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the fonts.

3.2 The Licensee may not sublicense, sell, lease, or distribute the fonts in any form, including but not limited to standalone or as part of a package.

3.3 The Licensee may not use the fonts to create obscene, defamatory, or unlawful designs or materials.

4. Intellectual Property

The fonts and their design are the intellectual property of the Licensor and are protected by copyright laws and international treaties.

5. Term and Termination

5.1 This EULA is effective until terminated. The Licensee’s rights under this EULA will terminate automatically without notice if the Licensee breaches any terms herein.

5.2 Upon termination, the Licensee must cease all use of the fonts and, if requested by the Licensor, destroy all copies of the fonts in the Licensee’s possession.

6. Warranty and Liability

6.1 The fonts are provided “as is” without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

6.2 The Licensor shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the fonts.

7. License Volume

7.1 The Licensee agrees to abide by the licensed volume as specified in the invoice or purchase confirmation. Any usage exceeding the licensed volume requires an additional license or upgrade, which may be subject to additional fees.

8. General

8.1 This EULA constitutes the entire agreement between the parties concerning the fonts and supersedes all prior agreements and understandings.

8.2 This EULA shall be governed by and construed in accordance with the laws of Norway.
